Xadya Terms of Service

§1. General provisions

These Terms of Service set out the rules for using the Xadya online service available at xadya.com (the “Service”).

The operator of the Service (the “Operator” or “Provider”) is:

Using the Service constitutes acceptance of these Terms in their entirety. If you do not accept these Terms, you have no right to use the Service.

§2. Age restriction

The Service is intended only for persons who are at least 18 years old. By using the Service you confirm that you are 18 or older. The Operator reserves the right to remove a user account if there is reasonable suspicion that the user does not meet the age requirement.

Content available in the Service may be of an adult (18+) nature. Access to the Service by minors is strictly prohibited.

§3. Registration and user account

Using the full functionality of the Service requires registration and the creation of an account. The user is required to provide truthful information during registration and to keep their login credentials confidential.

Each user may have only one account in the Service. Sharing an account with third parties is prohibited. The user bears full responsibility for actions taken from their account.

§4. Rules of using the Service

By using the Service, the user agrees to:

• comply with applicable law and these Terms,
• not infringe the rights of third parties,
• not send spam or advertising content,
• not attempt to compromise the security of the Service,
• not create content promoting violence, hatred or discrimination.

§5. Prohibited content

Creating, sending, or eliciting content via the Service is prohibited if it:

• depicts or suggests the involvement of minors in any sexual or violent scenes,
• promotes or glorifies physical violence, self-harm, or suicide,
• incites hatred or discrimination on the basis of race, gender, sexual orientation, religion, or other characteristics protected by law,
• infringes the copyright, trademarks, or other intellectual-property rights of third parties,
• impersonates real persons in a misleading way or in a manner that violates their personal rights,
• is unlawful under Polish or EU law.

The Operator uses content-moderation mechanisms (including automated AI moderation) and reserves the right to immediately remove content violating the rules above and to block the user account without prior notice.

§6. AI-generated content

The Service offers a feature to chat with AI-generated characters. Content generated by AI is fictional and intended for entertainment. The Operator is not responsible for content generated by AI but reserves the right to moderate and remove such content.

The user acknowledges that conversations with AI characters do not constitute legal, medical, psychological, or any other form of professional advice.

§7. Privacy and personal data

The Operator processes users' personal data in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Detailed information regarding the processing of personal data is set out in the Privacy Policy available in the Service.

By registering with the Service, you consent to the processing of your personal data to the extent necessary for the provision of services by electronic means.

§8. Intellectual property

All rights to the Service, including copyrights, trademarks, and other intellectual-property rights, belong to the Operator or to entities that have granted the Operator the appropriate licences. Copying, modifying, or distributing the Service's content without the Operator's consent is prohibited.

§9. Liability

The Operator is not liable for interruptions in the Service caused by technical reasons, force majeure, or other circumstances beyond the Operator's control. The Service is provided “as is” and the Operator does not guarantee continuity or freedom from errors.

§10. Virtual currency and payments

The Service offers a virtual currency in the form of Diamonds (💎). Diamonds are virtual accounting units with no monetary value and cannot be exchanged for cash or transferred to another account.

• The purchase of Diamonds is final and non-refundable, unless required otherwise by applicable law.
• By making a purchase, the user confirms that they are entitled to use the chosen payment method.
• Diamonds accumulated in the account expire irreversibly upon deletion of the user account.
• The Operator reserves the right to change the prices of Diamond packages and the scope of features available for Diamonds with reasonable advance notice.
• Payments are processed via external payment service providers. The Operator does not store payment-card data.

By purchasing Diamonds, the user consents to the immediate performance of the digital service and acknowledges that they thereby lose the right to withdraw from the contract pursuant to Article 38(1)(1) of the Polish Consumer Rights Act (Dz.U. 2014 item 827).

§11. Changes to these Terms

The Operator reserves the right to amend these Terms at any time. Users will be notified of material changes by e-mail or through a notice in the Service. Continued use of the Service after the changes take effect constitutes acceptance of the amended Terms.

§12. Final provisions

Matters not regulated by these Terms shall be governed by Polish law. Any disputes arising from the use of the Service will be settled by the court having jurisdiction over the Operator's seat.
